San Diego Alimony Lawyer

California Spousal Support Lawyer

Alimony can be a very emotionally laden part of a divorce. The spouse who sees himself or herself as more solvent may resent the idea of having to pay to support a former spouse. But, to the court, the goal of spousal support is to allow the spouse in need to be able to retain the status quo financially.

At The Law Office of Dawn Dell'Acqua APC, our San Diego alimony attorney can help you secure the financial stability that you will need moving forward with the divorce.

Temporary and Permanent Alimony

At the beginning of a divorce the judge will make a determination on the necessity of a temporary award of spousal support. The amount of the award will be determined by the judge using state guidelines that factor in the incomes of the spouse. The state guidelines utilize a formula that can create an unfair outcome. We can help ensure that any award of temporary spousal support is justified and correctly calculated.

Permanent alimony is something of a misnomer, as many of the courts are hesitant to create a lifetime award. But the court may create a spousal support award for a definite period, often half the length of the marriage. Factors that will be considered by the court when creating that award include:

  • The duration of the marriage
  • The presence of minor children
  • The capacity to earn income
  • The age and health of both partners
  • The capacity to learn new skills or a new trade

Awards of permanent spousal support are subject to the possibility of post divorce modifications.
